Acceptance of Terms
By accessing or using the Vesta platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including property owners, managers, and staff members.
Account Responsibilities
You are responsible for maintaining the accuracy of the information you provide when creating and managing your account. You must keep your login credentials secure and confidential. Each person should maintain only one account. You are responsible for all activity that occurs under your account, and you agree to notify us immediately of any unauthorized use.
Acceptable Use
The Service is intended for legitimate hotel and property management purposes. You agree not to use the Service for any unlawful purpose, attempt to gain unauthorized access to any part of the Service, interfere with or disrupt the integrity of the Service, or use automated systems to access the Service in a manner that exceeds reasonable usage. We reserve the right to suspend accounts that violate these terms.
Service Availability
We strive to maintain 99.9% uptime for the Service. Scheduled maintenance windows will be communicated at least 48 hours in advance via email. However, we do not guarantee uninterrupted or error-free operation. We are not liable for any downtime, whether scheduled or unscheduled, or for any loss of data or revenue resulting from service interruptions.
Data Ownership
All property data, guest records, booking information, and other content you enter into the Service remains your property. We do not claim ownership over your data. You may export your data at any time through the platform’s built-in export tools. We will not sell, share, or use your data for purposes other than providing and improving the Service.
Payment Terms
Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. Plan upgrades take effect immediately, and you will be charged the prorated difference. Plan downgrades take effect at the end of the current billing cycle. Annual plan subscribers may request a prorated refund within the first 30 days. All fees are non-refundable after that period unless required by applicable law.
Termination
Either party may terminate the agreement at any time. You may cancel your subscription through the account settings page. Upon cancellation, your account will remain accessible in a read-only state for 30 days, during which you may export your data. After the 30-day period, your data will be permanently deleted. We may terminate or suspend your account immediately if you violate these terms.
Limitation of Liability
To the maximum extent permitted by law, Vesta and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Service. Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
Changes to Terms
We may update these Terms of Service from time to time. When we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated terms. If you do not agree with the changes, you may cancel your account before they take effect.
